Sexual Harassment and Violence: Information and Legislation


Sexual harassment and violence can take many forms and can occur in many situations.

Within higher education institutions, they may concern incidents:

  • between students, during learning activities, in student life, or online;  
  • between staff members 
  • committed by a member of staff (academic, scientific, administrative, labour, etc.) against a student;  
  • committed by a student against a member of staff;  
  • committed by a third party against a student in the context of a placement;  
  • committed by a third-party against a student doing paid work within the institution;  
  • committed by a third party against a student within the institution or on campus.

Harassment and all forms of sexual violence are punishable by law!

When the victim is a student, in the context of teaching-related places or activities:

In addition, three pieces of legislation apply:  

  • Civil: Decree of 12th December 2008 on combating certain forms of discrimination covering cases of discriminatory harassment.     
  • Civil Code: General provisions on extra-contractual liability (Art. 1382 of The Civil Code).
  • Penal Code: Articles 442bis and 442ter and the law to combat sexism in the public space (Art. 444 of the Penal Code on slander and defamation).  

When the victim is a student on a work placement or apprenticeship contract, or working within the institution, or is working to fulfil aspects of their study programme or as part of their training:  

In addition, the legislation on well-being at work applies.   This legislation provides a framework for procedures when violence or harassment are involved, whether discriminatory or not.

When the victim is a member of staff:

In addition, the legislation on well-being at work applies.   This legislation provides a framework for procedures when violence or harassment are involved, whether discriminatory or not.

In the context of a complaint of discriminatory harassment, the legislation provides a mechanism to protect victims and witnesses from reprisals by the accused.
